1. Acceptance of Terms

By accessing or using Fablet AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.

3. Accounts and Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Service Description

Fablet AI allows users to upload photos to train custom AI models ("Personas") and utilize those models to generate synthetic images.

Disclaimer: The output is generated by Artificial Intelligence. We do not guarantee, and are not responsible for, the accuracy, quality, or uniqueness of the generated content.

5. User Content & License

Your Rights: You retain all rights to the photos you upload to the Service ("User Inputs") and the images generated by the Service ("Outputs"), subject to applicable laws.

License to Us: By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process your User Inputs solely for the purpose of providing the content generation service to you.

6. Prohibited Content

You agree not to use the Service to generate content that promotes, depicts, or facilitates:

  • Child Sexual Abuse Material (CSAM) or exploitation of minors.
  • Non-consensual sexual imagery (e.g., "deepfakes" of real people).
  • Graphic violence, gore, or self-harm.
  • Hate speech, discrimination, or extremist propaganda.
  • Fraud, impersonation, or deceptive practices.

Violation of these rules will result in immediate account termination and reporting to relevant authorities where required by law.

7. Payments & Credits

  • Subscriptions: Billed in advance on a recurring monthly basis. You can cancel at any time via your dashboard.
  • Credits: Credits are purchased for use within the application (training models, generating images). Credits have no monetary value outside the Service and are non-refundable.
  • Refunds: All sales are final. We do not offer refunds for partial subscription periods or unused credits, except as required by applicable law.

8. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Fablet AI and its licensors.

9. Limitation of Liability

In no event shall Fablet AI, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
